General sales conditions

In browsing this site, you acknowledge that you have read these general terms and conditions of sale, which you agree to respect. These terms are intended to inform you about the conditions and terms of reservation and cancellation, as well as each party's responsibilities.

Article 1: Pricing

The prices indicated are for accommodation (room, bed, etc.) or other services, for the number of people and the selected date(s), unless otherwise stated (packages).

The conversion into the customer's currency is for informational purposes only and is not contractual. Any fees related to the conversion between the hotel’s currency and the customer’s currency (exchange rates, bank charges) are the customer's responsibility.

* Unless included in the price or specifically selected during the reservation, additional services (breakfast, half-board, full board, etc.) are optional and to be paid on-site.

Taxes are included in the price or indicated in the tax breakdown. However, some additional taxes may be charged upon arrival at the hotel, depending on local regulations in effect.

Article 2: Reservations

By connecting to the website www.hotel-villakoegui-bayonne.fr, your reservation is made directly with the hotel.

Our establishment has a real-time reservation system that is updated instantly. Thus, once you have validated your reservation, you will receive a confirmation email. We kindly ask you to print the reservation confirmation you will receive by email. It will be requested by the hotel upon check-in.

Hotel Villa KOEGUI may change the rates of the different rooms at any time without it affecting the customer, who will be charged the rate in effect on the day of the reservation, unless there are changes in the applicable taxes or the introduction of new taxes.

Article 3: Payment Terms

To reserve one or more rooms, you must provide your credit card details.

  • In the case of a flexible reservation: No amount will be charged at the time of booking, but we will perform a pre-authorization on the card for the total amount of your stay on the day of your booking. The cost of the stay may be paid by the customer directly on-site upon check-in and/or check-out, using the payment method of their choice.
  • 2. Non-cancellable, non-refundable reservation:

    In the case of a non-cancellable, non-refundable reservation, the hotel will charge the total amount of your reservation upon confirmation (excluding tourist taxes).
  • 3. Payment Methods:

    Credit cards accepted for online payment: MasterCard, Visa, American Express.

    On-site payment: Cash, vacation checks ANCV, credit cards.

    For payments made with an American Express card, additional fees may apply.

    This list is subject to change.

    You must provide your credit card number and its expiration date when making your reservation. The card must be valid on the date of departure for the customer's stay. In case of invalid payment details, the hotel reserves the right to immediately cancel the reservation without notice.

    Our reservation system is secure, and your credit card number and personal data provided are protected.

    The establishment may also request you to present an ID to prevent credit card fraud.
  • 4. If the Client has not prepaid their stay online, the Establishment may request a security deposit or a pre-authorization to charge the credit card upon arrival, to guarantee the payment of the services consumed on-site.
  • 5. Pre-authorization Procedure:

    The pre-authorization procedure involves a guarantee for an estimated amount of the stay and authorizes payment based on the Client’s actual expenses up to the authorized amount. Only the actual invoice amount will be debited at the end of the stay.

    The authorization request includes the reservation amount (or remaining amount if partially prepaid) and a fixed amount to cover potential additional expenses (e.g., breakfast not included, restaurant, bar, city tax, etc.).

    The authorization is not an immediate debit but a reserve for future payment, authorized by the Client's bank, temporarily reducing the credit card limit. In rare cases, the authorization request may appear as a pending charge.

    Once the authorization is confirmed by the bank, at the end of the stay, the hotel sends a debit request to the bank for the invoice amount.

    When the authorization request has been activated and confirmed by the bank, at the end of the stay, the Establishment sends the Client's bank a debit request corresponding to the invoice amount:

    • if the Invoice is lower than the amount of the authorization request, the actual card debit will be equal to the amount actually owed by the Client. The card limit will then be adjusted (released) by the Client's bank taking this difference into account (with a variable delay depending on the banks);
      Example: Authorization request of 300 euros, final invoice of 260 euros = debit of 260 euros and cancellation of the authorization request for the remaining 40 euros.
    • if the invoice is higher than the amount of the authorization request, the full amount of the request will be used by the Establishment. The remaining expenses will be debited in addition on the same card. Two debits are therefore made to the Client's account. One corresponds to the amount of the authorization request and the other to the supplement. However, it is recommended that the Client return to the reception to regularize the authorization request amount or pay directly. Example: Authorization request of 300 euros, final invoice of 320 euros = debit of 300 euros + debit of 20 euros.

    In some Establishments, the currency used by the Establishment for the invoice may differ from the one used for the authorization request. In this case, the amount actually debited may also differ from the amount of the authorization request due to possible fluctuations in exchange rates between the date of the authorization request and the invoice date.

    In rare cases, the authorization request may result in a debit by the Client's bank before the actual debit is processed. In this case, the debit will not occur twice. The balance, if in the Client's favor, will be automatically credited back to the Client by the bank.

    If the Client, on the Establishment's proposal, has chosen to prepay for their entire stay upon arrival, any additional expenses within the Establishment cannot be added to the room account and will need to be paid directly at the time of consumption.

    If the reservation is canceled after the authorization request has been activated, a cancellation request for the authorization will automatically be sent to the bank of the cardholder. In rare cases, this cancellation may appear as a refund.

    It should be noted that the consideration of the release of the pre-authorized amount (or refund) usually takes twenty-four (24) to forty-eight (48) hours, but the delay may extend to seven (7) business days or more, depending on the cardholder's bank.

Article 4: Reservation Guarantee – Check-in and Check-out

Hotel Villa KOEGUI Hotel is open 24/7.

The reservation officially begins at 3:00 PM on the day of the client's arrival and ends at 12:00 PM on the day of departure.

Early Check-in – Late Check-out: Subject to availability, the Client can request to access their room before 3:00 PM on the arrival day or keep the room until 4:00 PM on the departure day. Article 5: Pets

Our hotel does not accept pets.

Article 6: Creating your "Villa KOEGUI" account

On the HOTELS website, clients have the option to create a Club account.

Through said account, clients can:

  • Modify their personal information
  • Access a summary of current and previous bookings;
  • Get in touch with Customer Service;
  • Benefit from commercial advantages.

Article 7: Cancelling or modifying a booking:

For Accommodation Services (room reservations within an Establishment or other types of accommodation), the Client is reminded that they do not have the right of withdrawal provided in Article L. 221-18 of the Consumer Code, in accordance with Article L. 221-28, paragraph 12 of the Consumer Code, which excludes this right for contracts related to accommodation services that must be provided on a specific date or period.

For each Service reservation, the Specific Terms will specify the conditions for cancellation and/or modification of the reservation.

Prepaid reservations cannot be modified and/or cancelled. Prepaid amounts are non-refundable. This will be stated in the Specific Terms.

Where the Specific Terms allow it:

  • cancellation of a Service reservation can be made directly on the website under the ""Consult or cancel your reservation"" section or by contacting the reception desk via email: contact@villakoegui-bayonne.fr.
  • Modification of a Service reservation can be done directly with the Establishment, whose contact details, including its phone number, are provided in the reservation confirmation email.

In the event of interruption of a Service by the Client, the full agreed price will be charged. For prepaid reservations, no refund will be given.

In the case of Accommodation Services, unless otherwise expressly stated in the Specific Terms, the Client must leave the room before the indicated check-out time (12:00 PM on the last day of the reservation). Late check-out exceptions apply.

When the Client has booked a flexible night (with modification possibility), they can change the date or type of room up to 72 hours before their stay, subject to availability. The rate charged will be the current rate at the time of modification, and a new quote will be provided to the Client to confirm the new rate.

Article 8: Insurance and Liability

A safe is provided in each room. The hotel is not responsible for theft, loss, or damage to personal belongings during the stay.

The client must inform the establishment of any damage they cause. They are responsible for all damages caused and agree to bear the costs of restoring the premises if necessary.

The hotel reserves the right to charge the credit card provided during booking for any extras or unreported services at check-out.

  • The Client, particularly when making a final reservation for a Service, agrees to pay the price and comply with the Specific Terms. Any reservation or payment that is irregular, incomplete, or fraudulent will result in the cancellation of the Service reservation at the Client’s expense, without prejudice to any legal action Villa KOEGUI may take against the Client.
  • Any behavior contrary to good morals or public order within the Establishment, or failure to comply with the Establishment's Internal Regulations, may result in the Client being asked to leave without compensation or refund if payment has already been made.
  • The Client also agrees that the IT resources made available to them by the Establishment (including the WiFi network) will not be used in any way for the reproduction, representation, making available, or communication to the public of works or objects protected by copyright or related rights, such as texts, images, photographs, musical works, audiovisual works, software, and video games, without the authorization of the rights holders as provided in Books I and II of the Intellectual Property Code when such authorization is required. The Client is also required to comply with the security policy of the Establishment's internet service provider, including the rules for using the security measures implemented to prevent the illicit use of IT resources and to refrain from any action that may compromise the effectiveness of these measures.

Article 9: Force majeure

"Neither party will be held responsible for failure to perform its obligations due to force majeure. Force majeure suspends the obligations of both parties, with each party bearing the costs arising from it. Force majeure cases include those recognized by the courts (strikes, attacks, deaths, etc.). If the force majeure event lasts more than 30 days, either party may terminate the agreement without compensation.In case of force majeure or other exceptional events preventing the Service from being provided, the Establishment may relocate the Client to a similar establishment or offer another equivalent service, with prior consent from the Client.In case of relocation, the choice of establishment will be made by the hotel itself. The costs of relocation will be covered by the hotel, unless due to force majeure as detailed above."

Article 10: Commitment

The submission of required banking information and the acceptance of these General Conditions and Specific Terms electronically constitutes an electronic contract between the parties, serving as proof of the reservation and the amounts due for it.

he General Conditions and Specific Terms express the full obligations of the parties. No other conditions communicated by the Client will be integrated.

If there is a contradiction between the Specific Terms and General Conditions, the Specific Terms will apply.

The official language is French. In case of a translation dispute, the French version prevails.

Article 11: Personal Event

When the Client uses the website, including when making a reservation, Villa KOEGUI Hotels process personal data as described in the ""Privacy Policy.""T

he Client is informed on each data collection form whether the information is mandatory or optional. Failure to provide mandatory information may prevent the hotel from processing the reservation.

The collected information is intended for Villa KOEGUI Hotels, its entities, partners, and service providers (including online payment providers) for executing the reservation or taking pre-contractual measures. Once the necessary data protection measures are in place, data may be transferred outside of Europe to countries without equivalent data protection.

The Client has the right to exercise their rights under applicable data protection laws, as detailed in the "Privacy Policy."
